The Administrative Court of Düsseldorf has rejected the emergency application of a large day care provider. The city must not extend the cooperation contract with the non-profit GmbH. Nine locations in the city are affected, where up to 81 children are currently being cared for. The 19th Chamber based its decision on several serious breaches. The provider had invoiced care hours that had not actually been provided. In addition, she had offered parents only 45-hour contracts as a rule – regardless of whether the actual need was lower. The court evaluated this as a clear orientation towards maximum revenue. Furthermore, the Chamber found that the provider had taken undue influence on the communication between parents, caregivers and the youth office – up to recommendations to make false statements to the youth office. The provider had invoiced hours that had not been provided and had pushed parents to make false statements to the youth office. For dozens of cared-for children, this means an uncertain situation from August.
